Terms of Service

These Terms of Service ("Terms") govern your use of MapArtPrint ("the Service", "we", "us", "our"). By using the Service, you agree to these Terms and our Privacy Policy.

1. What We Provide

MapArtPrint is a web-based tool that lets you design custom map art, choose styles and sizes, and download your creation as a PNG image. Some styles and large formats require a one-time payment.

2. Eligibility

You must be at least 16 years old to use the Service. If you are under 18, you should have parental or guardian consent.

3. Payment

• Payments are processed by Stripe. We do not store your card details.
• The one-time fee ($4.99) unlocks premium styles and large-format downloads for that export session.
• Prices are in USD. All sales are final. Refunds are only provided at our sole discretion or where required by applicable law. Contact us at hello@mapartprint.com.

4. Map Data & Licences

Map imagery and data come from third-party providers:

• OpenStreetMap — © OpenStreetMap contributors, ODbL
• MapTiler — map styles and tiles

Your use: Personal and editorial use of your exported map is fine. For commercial use (e.g. selling prints or using in advertising), you must comply with the licences of OpenStreetMap and MapTiler. Contact us if you need clarification.

Accuracy disclaimer: Map data is provided by third parties. We do not guarantee the accuracy, completeness, or currentness of any map content. Do not rely on our maps for navigation, legal, or critical decisions.

5. What You Create

You own the map artworks you create. By using the Service, you grant us a limited licence to process and deliver your design (e.g. rendering the map and serving the download). We do not sell or commercially exploit your creations.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal, fraudulent, or harmful purpose
• Attempt to access, disrupt, reverse engineer, or harm our systems, infrastructure, or other users
• Scrape, harvest, automate, or abuse the Service beyond normal personal use
• Circumvent payment, access controls, or technical limitations
• Use the Service to create content that infringes third-party rights or violates any law
• Resell, sublicense, or commercially exploit the Service itself (your created maps may be used per Section 5)

7. Our Intellectual Property

The Service, including its design, features, and branding, is owned by us or our licensors. You may not copy, reverse engineer, or resell the Service.

8. Third-Party Services

The Service uses Stripe, MapTiler, OpenStreetMap, Google Fonts, and others. Their terms and policies apply to their services. We are not responsible for their conduct, availability, accuracy, or any loss arising from their services. Your use of third-party services is at your own risk.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. We do not guarantee:

• Uninterrupted, timely, secure, or error-free access
• Accuracy, completeness, or reliability of map data or content
• That the Service will meet your requirements or expectations
• That defects will be corrected

We may modify, suspend, or discontinue the Service at any time without notice or liability.

10. Limitation of Liability

To the fullest extent permitted by applicable law (including Swiss law, except where mandatory provisions provide otherwise):

• We exclude liability for indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunity
• We exclude liability for any loss arising from third-party services, your use of exported content, or circumstances beyond our reasonable control
• Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you actually paid us in the 12 months preceding the claim (or, if you paid nothing, CHF 10)

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law. Where mandatory consumer protection provisions apply, they take precedence.

11. Indemnification

You agree to indemnify, defend, and hold harmless MapArtPrint, its operators, affiliates, and agents from and against any and all claims, damages, losses, costs (including reasonable legal fees), and liabilities arising from or related to: (a) your use of the Service; (b) content you create, export, or distribute using the Service; (c) your violation of these Terms or any applicable law; (d) your infringement of any third-party rights; or (e) any dispute between you and a third party in connection with the Service. This indemnity survives termination of your use of the Service.

12. Force Majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, embargo, government action, pandemic, strike, failure of third-party services or utilities, or internet or telecommunications outages.

13. Statute of Limitations

Any claim or cause of action arising from these Terms or the Service must be brought within one (1) year of the date the claim arose, or be forever barred. This does not affect longer limitation periods that may apply under mandatory law.

14. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

15. Governing Law

These Terms are governed by the laws of Switzerland, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Switzerland.

16. Changes

We may update these Terms. The "Last updated" date will change. Continued use after changes means you accept the new Terms. If you disagree, please stop using the Service.
